GOP's Christie announcement could come any day

(AP) ? New Jersey Gov. Chris Christie is expected to say any day now whether he will reverse his long-held decision to stay out of the 2012 Republican presidential campaign.

While the hotly courted first-term Republican governor's candidacy hangs over the race, his two chief would-be rivals were conducting campaign business as usual.

Former Massachusetts Gov. Mitt Romney was preparing for a big speech on foreign policy, while Texas Gov. Rick Perry was planning a weekend dive deep into conservative northwest Iowa.

Meanwhile, Christie has been silent in early-voting primary states, and if he decides to join the Republican presidential race, he would face the challenge of launching a campaign from a standing start.

Neither Christie nor his political team has reached out to GOP strategists or top party officials in Iowa or New Hampshire as the first-term governor re-evaluates his oft-repeated refusal to seek the Republican nomination.

His lack of spadework would complicate an undertaking that already requires raising millions of dollars and establishing operations in several states simultaneously. Adding to the challenges, Florida last week moved its primary into January, pushing the start of the 2012 nominating contests to barely three months away.

But Christie's renewed look at a presidential bid ? without making a round of calls even to new, influential friends in Iowa and New Hampshire ? reflects confidence within Christie's circle that the adoring and hungry Republican elites who have courted him can compensate for his organizational deficit with momentum.

As early as this week, Christie could announce whether he will run and reverse himself after more than a year of ruling out a candidacy. But campaign operatives, fundraisers and veteran presidential campaign advisers in Iowa and New Hampshire say no one with Christie has contacted them in recent weeks.

Iowa Gov. Terry Branstad, who has said he was wowed by Christie's plainspoken style and call for revamping public employee benefits, would provide a natural entry point for Christie in the leadoff caucus state.

But Christie and Branstad haven't talked since Christie headlined an education conference at the Iowa governor's invitation in July, Branstad spokesman Tim Albrecht said.

Christie advisers have kept in loose touch with some Iowa Republicans, led by Branstad's top fundraiser, Bruce Rastetter, who urged Christie to run when they met in New Jersey in May.

Rastetter declined to say whether he had recently heard from Christie.

In South Carolina, organizers close to the New Jersey governor have been making calls to key activists in the first Southern primary state to feel them out on organization and strategy.

"People who are involved in trying to get the governor to run have begun to come up with campaign plans in case he decides to run," said a South Carolina GOP leader who did not want to be identified to avoid pre-empting a possible Christie announcement. The Christie organizer "called up and said, 'If he decided to run, do you think he would be able to be competitive in South Carolina?'"

Christie buzz was even quieter in New Hampshire. The governor has visited neither New Hampshire nor South Carolina since taking office last year.

There is a sense that time is very tight for Christie to assemble a team for the 2012 contests, expected to begin about a month earlier than planned with Florida's decision to hold its primary Jan. 31. The move probably would force Iowa and New Hampshire into the early part of January.

One complication for Christie is that other campaigns ? already several weeks if not months under way ? have gobbled up key staff in the early contest states.

"I haven't heard from his people. And I haven't heard of anybody who's heard from any of his people," said Jennifer Horn, a leading New Hampshire activist and recent congressional candidate. "Staffing certainly will be a challenge in New Hampshire."

New Hampshire Republican National Committeeman Steve Duprey is more blunt.

"It's virtually impossible" for someone like Christie, or even the better-known former Alaska Gov. Sarah Palin, to jump into the race with voting expected to begin in less than four months, Duprey said.

Longtime Branstad confidant Richard Schwarm said the same.

"If I'd been advising Gov. Christie, I would have said it's too late before Florida moved up, now it's certainly too late," said Schwarm, a former state GOP chairman.

Despite the intense courtship from top national GOP donors, which picked up after Perry failed to impress some influential party elites in debates last month, little is known about Christie in early states. Activists are drawn to his national star power and no-nonsense public persona, but have not yet dug into his positions on social issues, such as gun, abortion and gay rights, central issues that are disproportionately influential to the early-state GOP base.

"At the 30,000-foot level he looks good. But he's not being vetted as a presidential candidate yet," said New Hampshire Rep. Frank Guinta, a Republican who says he hasn't heard from Christie's camp in several months.

NEW YORK ? Oil prices are back to where they were a year ago.

On Friday benchmark crude dropped $2.94, or 3.6 percent, to end the day at $79.20 per barrel in New York. Prices haven't finished that low since Sept. 29, 2010. Since then crude peaked near $114 a barrel in May of this year. It's fallen 31 percent since then as worries grew about the global economy.

Government data pointed to further economic troubles heading into a traditionally weak time for petroleum demand. The Commerce Department said that Americans are earning less money, which could affect consumer spending and demand for oil. And October is usually a slow month in the oil business. The summer driving season is over, and it will be a couple of months before heating demand perks up and travelers set out for winter holidays.

"There just isn't any demand here in the U.S.," independent oil analyst Andrew Lipow said.

Brent crude, used to price many international kinds of oil, lost $1.19 to finish at $102.76 in London.

Oil has swung up and down in the last few weeks, as the European financial crisis roiled energy markets. By Friday traders had turned their attention to falling crude price forecasts from major investment firms.

Morgan Stanley this week dropped its forecast for Brent crude by $30 to an average of $100 per barrel in 2012. Analyst Hussein Allidina cut the price to match tepid global economic growth and a recovery in Libyan oil production.

Allidina expects "significant supply increases and a material slowing in demand" by the second quarter of next year.

Gasoline has not fallen as much as oil. At the pump, a gallon of regular fell a penny to a national average of $3.445, according to AAA, Wright Express and Oil Price Information Service. That's a dime lower than a week ago but still 76 cents higher than the same time last year. A gallon of regular peaked this year at $3.98 on May 5.

In other energy trading, heating oil fell 4.73 cents to finish at $2.7793 per gallon and gasoline futures dropped 2.05 cents to end at $2.5381 per gallon. Natural gas lost 8.1 cents to end the day at $3.666 per 1,000 cubic feet.

Obama appeals health care setback to high court (AP)

WASHINGTON ? Raising prospects for a major election-year ruling, the Obama administration launched its Supreme Court defense of its landmark health care overhaul Wednesday, appealing what it called a "fundamentally flawed" appeals court decision that declared the law's central provision unconstitutional.

Destined from the start for a high court showdown, the health care law affecting virtually every American seems sure to figure prominently in President Barack Obama's campaign for re-election next year. Republican contenders are already assailing it in virtually every debate and speech.

The administration formally appealed a ruling by the federal appeals court in Atlanta that struck down the law's core requirement that individuals buy health insurance or pay a penalty beginning in 2014.

At the same time, however, the winners in that appellate case, 26 states and the National Federation of Independent Business, also asked for high court review Wednesday, saying the entire law, and not just the individual insurance mandate, should be struck down.

The Supreme Court almost always weighs in when a lower court has struck down all or part of a federal law, to say nothing of one that aims to extend insurance coverage to more than 30 million Americans.

The bigger question had been the timing. The administration's filing makes it more likely that the case will be heard and decided in the term that begins next week.

Repeating arguments it has made in courts across the country in response to many challenges to the law, the administration said Congress was well within its constitutional power to enact the insurance requirement.

Disagreeing with that, the 26 states and business group said in their filings that the justices should act before the 2012 presidential election because of uncertainty over costs and requirements.

On the issue of timing, their cause got an unexpected boost from retired Supreme Court Justice John Paul Stevens, who said voters would be better off if they knew the law's fate law before casting their ballots next year.

The 91-year-old Stevens said in an Associated Press interview that the justices would not shy away from deciding the case in the middle of a presidential campaign and would be doing the country a service. "It would be better to have that known about than be speculated as a part of the political argument," Stevens said in his Supreme Court office overlooking the Capitol.

Though the Atlanta appeals court struck down the individual insurance requirement, it upheld the rest of the law. The states and the business group say that would still impose huge new costs.

In another challenge to the same law, the federal appeals court in Cincinnati sided with the administration. In a separate Supreme Court filing Tuesday night, the Obama administration said it does not appear necessary to grant review of the Cincinnati case and the government added that consolidating the two cases could complicate the presentation of arguments "without a sufficient corresponding benefit."

The law would extend health coverage mainly through subsidies to purchase private insurance and an expansion of Medicaid. The states object to the Medicaid expansion and a provision forcing them to cover their employees' health care at a level set by the government.

The individual insurance mandate "indisputably served as the centerpiece of the delicate compromise that produced" the law, according to the states, with Florida taking the lead.

The administration said in the Atlanta-based 11th U.S. Circuit Court of Appeals that the law's changes in the insurance market, including requiring insurers to cover people without regard for pre-existing health conditions, would not work without the participation mandate.

The insurance requirement is intended to force healthier people who might otherwise forgo insurance into the pool of insured, helping to reduce private insurers' financial risk.

Both appeals stressed the importance of resolving the overhaul's constitutionality as soon as possible, which under normal court procedures would be by June 2012.

While a decision in that time frame would come in the midst of a heated presidential campaign, the NFIB said it is more important to resolve uncertainty about costs and requirements than drag out consideration into 2013 or beyond.

"When you talk to our members and other small-business owners about what is the biggest problem they're facing, they say uncertainty," said Karen Harned, executive director of the NFIB's legal division. "When you ask what, one of first answers is the health care law."

Stevens, who retired last year, said his former colleagues would not be affected by the potential impact of their decision on Obama's re-election chances.

"They'll decide it on the law. I'm totally convinced of that," he said.

Obama appointed Stevens' successor, Elena Kagan.

Stevens said that if he still had a vote on the court on timing, he would cast it in favor of hearing the case sooner rather than later. He would not say how he would vote on the issue of the law's constitutionality, although he said the court's 6-3 decision in a 2005 case involving medical marijuana seems to lend support to the administration's defense of the law.

Stevens wrote the opinion that held that the Constitution allows federal regulation of homegrown marijuana as interstate commerce. A central dispute in the health care case is over Congress's power under the Constitution's commerce clause to mandate the purchase of health insurance.

In addition to the competing rulings on the law's validity, a federal appeals court in Richmond, Va., ruled that it was premature to decide the law's constitutionality. Citing a federal law aimed at preventing lawsuits from tying up tax collection, that court held that a definitive ruling could come only after taxpayers begin paying the penalty for not purchasing insurance.

The administration suggested that the Supreme Court should consider that issue because of the appellate ruling.

The federal appeals court in Washington, D.C., also heard arguments in yet another lawsuit against the overhaul last week. That court has no timetable for its decision.

The other states aligned with Florida are: Alabama, Alaska, Arizona, Colorado, Georgia, Idaho, Indiana, Iowa, Kansas, Louisiana, Maine, Michigan, Mississippi, Nebraska, Nevada, North Dakota, Ohio, Pennsylvania, South Carolina, South Dakota, Texas, Utah, Washington, Wisconsin and Wyoming.
